Business and service restrictions applicable in Alberta

In Alberta, due to COVID-19 some businesses are required to either temporarily close down, or to reduce their capacity or limit their in-person access. Specific details regarding this are outlined in the Chief Medical Officer of Health (CMOH) order 42-2020 that rescinds CMOH order 38-2020.

This order, effective 13th December 2020 covers in its purview masks, gatherings and business restrictions and has implications in international business law Calgary.

Retail
All retail services have to reduce their customer capacity to 15% of fire code occupancy (not including staff), or a minimum of 5 customers:

• Curbside pick- up, delivery and online services are to be given more support.
• You can either shop alone, if allowed, or only with folks that you live with.
• For shopping malls:
• There is a capacity limit of 15% include common areas and individual stores.
• Food courts are open for grab and go only.
• Retail services include businesses operating within a shopping mall, pet supplies, groceries, pharmacies, clothing
• stores, computer & IT outlets, hardware and DIY, automotive, sporting goods, liquor and cannabis, and gift shops

Restaurants, bars, pubs, lounges and cafes
All restaurants, pubs, bars, lounges and cafes are to be closed to in-person service, although take out, curbside pickup and delivery services are allowed.

Entertainment & recreation facilities
All such facilities are to remain closed. These include casinos, gaming centers, racing centers, horse tracks, bowling alleys, pool halls, private clubs & night clubs, art galleries, libraries and museums, amusement parks & water parks, play-centers, indoor playgrounds, movie theaters, concert halls, banquet halls, conference halls and trade shows.

Personal & Wellness services
These facilities are also to remain closed. They include aesthetics, manicure, pedicure, body waxing, make-up, body, nose and ear piercing, tattoos, facial, eyebrow and eyelash treatments, cosmetic skin treatments, laser hair removal, hairstyling and barbering, massage therapy, floatation tanks, reflexology and colonic irrigation.

Health, Social and Professional services

These service providers are allowed to remain open, but they must maintain public health orders and follow sector guidance. Further, appointments are to be provided on a one-on-one basis. These service providers include physicians, dentists, physical therapists, optometrists, chiropractors, hearing aid practitioners, acupuncturists, and naturopaths.

Professional service providers such as lawyers, mediators, accountants and photographers are allowed to operate only by an appointment.

Social services providers are allowed to remain open for in-person services that include social, protective or emergency services, shelters for vulnerable persons and not-for-profit community kitchens, religious kitchens and soup kitchens.

Hotels, motels, hunting and fishing lodges
Hotels, motels, hunting and fishing lodges are allowed to remain open, but have to follow certain restrictions such as they must not allow their guests access to a spa, pool or a gym. Secondly, they must allow room services only, that is no in-person dining.

Performance activities
Performance activities are classified as those that involve dancing, singing, theatre and playing wind instruments.

Outdoors
Rehearsals and practices can take place for up to ten people, as long as physical distancing norms and other guidelines are followed. Doing a performance with audiences is not allowed.

Indoors
Group performances are not allowed. Rehearsals, practices and lessons are also not allowed, unless they are 1-to-1 with an instructor.

Providing lessons
1-to-1 in-person providing of lessons is allowed, but these cannot be provided in facilities that are closed under the current measures. Online lessons are highly encouraged.

In schools
Activities related to physical education, band and drama are permitted, but assemblies, concerts, and inter-school activities and competitions are not allowed.

Places of worship
Group performance activities that are conducted indoor are allowed. Examples are choir singing, playing music as long as they are a part of worship and not for entertainment.

Sports and physical activities
Group physical activities comprising team sports, fitness classes and training sessions, are prohibited or restricted across Alberta.

Outdoor activities
Outdoor group physical activity is allowed only up to 10 people. Activity is encouraged for members of the same household and members of other households must maintain a 2 metre distance.

Indoor activities
Indoor group physical activities are prohibited unless the group only involves members of the same household, or the activity is part of an education program. One-to-one indoor training with a fitness trainer is permitted.

Conclusion
